In his written order, Justice Shah said there were economic benefits of the alternative dispute resolution system. He described it as an affordable, effective and secret dispute resolution method. He said the alternative dispute resolution system decreases burdens on the courts and increases people’s business and production skills. He said the alternative dispute resolution system helps resolve disputes early and saves businesses from going into dispute.
He said the court was told that the draft of the Alternative Dispute Resolution was presented to the government through the Law Ministry on May 2, 2024. He said the draft law seeks to modernize the old alternative dispute resolution system, which has been unchanged since 1940. He expressed the hope that the government would enforce the new dispute resolution system soon in the larger interest of people of Pakistan.
