ISLAMABAD – The draft of constitutional amendment that was passed by the special committee of parliament appeared on Friday..
The draft said that the judicial commission would decide the number of constitutional benches and judges. The suo motu powers would rest with the constitutional benches according to the proposed amendment in Article 184.The draft includes a proposed amendment to Article 48, ensuring that advice sent to the president by the prime minister and cabinet cannot be challenged in any court.Four senior most judges of Supreme Court along with the chief justice would be the members of judicial commission.
It has also been proposed to include two members each from the National Assembly and Senate in the judicial commission.The special parliamentary committee on Friday approved the 11-pages draft which would be presented in the cabinet meeting tomorrow.Meanwhile, amendments were proposed in the Article 38, 48 and 81.The CJP would be appointed on the recommendation of the special parliamentary committee.The 12-members committee would have 8 MNAs and 4 Senators.
