SC Bench Recalls Orders of Justice Mansoor Ali Shah

A constitutional bench of the Supreme Court of Pakistan has withdrawn the decisions of Justice Mansoor Ali Shah dated January 13 and 16 regarding a customs regulator duty case. The bench, headed by Justice Amin Uddin, expressed concerns over inconsistencies in the scheduling of the case and questioned the authority of a separated judge to dictate the bench for a specific case. The court also ordered the Nazar Abbas contempt of court case to be linked to the customs duty case.

ISLAMABAD: Constitutional bench of the Supreme Court withdrew the decision of Justice Mansoor Ali Shah January 13 and 16. A constitutional bench of the Supreme Court heard the customs regulator duty case headed by Justice Amin Uddin during which the concerned authorities and lawyers appeared in court.

During the hearing Justice Amin Uddin said, the order was held on January 13 that the hearing will be held on January 27, then how did the hearing suddenly be fixed the next day? Justice Jamal Mandokhel said, if a judge was separated from a 3 -member bench, could he order the judge that the case was filed in front of a specific bench?Justice Naeem Afghan told lawyer Barrister Salah Uddin, “We think you are responsible for all the dispute”. Justice Mazhar said, according to the court order, “you insisted that the regular bench could hear the case”. Justice Mandokhel asked Barrister Salah Uddin, “Do you not trust the judges?” If I am disqualified or I do not know the law, tell me, if no one likes the new system, it is a different thing. Justice Mazhar said, it was said in the January 16 order, the case was heard, the case or heard or not heard, it was heard, where did the term come from? I do not understand the Attorney General should be considered as hearing without giving the notice of Rule 27. Attorney General said on this that, he had two orders on January 13, the next hearing of the case is on January 27, the next date of the case in the second order is January 16. Justice Mandokhel said, “Do not work illegally, work in a way, did we issue a contempt of court notice to the regular bench?” We just heard the case. Justice Naeem Afghan said, the case stated in the verdict yesterday should be fixed for hearing in the same bench.
